The parties agree that the Lessor is not the manufacturer of the Equipment nor the agent of the manufacturer and
that no warranty is given against evident or hidden defects in material, workmanship or capacity.
In the event that the Equipment becomes unsafe or in a state of disrepair, Lessee agrees to immediately
discontinue its use and promptly return it to the Lesser. If the condition is the fault of the Lessor, the Lessor shall
replace it with Equipment of a like kind in good working order.
At the completion of its use on site, the Lessee will promptly return the Equipment and all its parts and
attachments to the Lessor’s place of business. It is to be in the same condition as it was received, ordinary wear
and tear excepted. The Lessee agrees to pay for any damage to the Equipment, loss of its parts or attachments
during the Rental Period.

Fusion Rental Terms and Conditions
Lessee acknowledges receipt of the Equipment upon its arrival on site. Both parties agree that the Equipment wa
inspected by the Lessor before shipment and the Lessee at the time of delivery and was accepted by the Lessee i
good and serviceable condition.
Title to the Equipment is and at all times shall remain in the Lessor. Only the parties hereto and those other
persons designated by the Lessee are authorized to use the Equipment. The Lessee assumes full responsibility for
any use of the Equipment whatsoever during the Rental Period.
RETURN:
Lessee is responsible for return of rental unit at lessee expense. Rental unit should be returned to
SIMTECH, 47-A RUNWAY ROAD, LEVITTOWN PA 19057
. Rental unit must be marked with Simtech
rental number for receiving. (Rental period ends when fusion unit is received at Simtech). Failure to properly
mark / tag unit will result in delay of this process.
Lessor shall not be liable to Lessee for any loss, delay or damage of any kind resulting from late arrival, defects,
inefficiency or breakage of the Equipment.
Lessee agrees to indemnify and save harmless the Lessor against all loss, damage, expense and penalty arising
on account of any injury to person or property occasioned by the operation, handling or transportation of the
Equipment during the Rental Period. Lessee waives and releases Lessor from all claims for injuries or damages to
Lessee arising out of the use of the Equipment by Lessee.
Lessee will give Lessor immediate notice of any levy attempted upon the Equipment or if the Equipment for any
cause becomes liable to seizure, and indemnify Lessor against all loss and damages caused by such action,
including Lessor’s reasonable attorney’s fees and expenses.
Lessor will invoice rental charges weekly in advance. Repairs to the Equipment, if any, will be invoiced after
repair work is complete. Lessee will pay all charges within 15 days of invoice date. Should collection or
litigation become necessary, Lessee agrees to pay all charges, including reasonable attorney’s fees and court
cost.
